General conditions

The present rent is made for responsibilities and conditions appearing on your contract as well as on the following general conditions:


1. LEGAL REGIME OF THE CONTRACT

The present reservation is concluded as temporary residence and as sailing. Premises cannot be used as even secondary or main house and the customer can practise no commercial, home-made or professional activity there.
As a consequence, the contract will be governed by the measures of the civil code as well as by the conditions planned in the present.

2. TIME OF RENT

The duration of the rent is planned to the contract.
The rent is made for definite duration in advance which will begin to run the first agreed day, at 5 pm, until the last agreed day, at 11 am. The lease stops by rights at the expiration of the term fixed to the contract, without that it is necessary need to give leave. The duration of the rent cannot be extended without the preliminary agreement of HomeDay.


3. THE CONTRACT

- Booking by the customer
The customer proceeds to the booking of the accommodation by sending a demand of estimate for HomeDay and by fulfillling, either of a deposit, or a totality of the amount of the rent. He recognizes, by sending his demand of estimate, to have accepted the terms of the present general conditions and to have acquainted with the descriptive state of the apartment concerned by his demand of estimate.


- Confirmation by At HomeDay
Within de 15 days as from the reception of the payment of the deposit or the totality of the amount of the rent, Homeday sends an E-mail:


Or confirming to the customer the availability of premises and the good reception of the payment. HomeDay sends then the contract to the customer one month before the beginning of the stay. The commitment of the parts is sealed by the sending of the E-mail confirming the availability of premises and the good reception of the payment.
If the customer paid deposit, the balance of the price of the rent is payable in the delivery of keys.

Or indicating that premises are not available any more for wished period. In this hypothesis, the paid sum is entirely paid off within 8 days as from the sending of the E-mail.

On inquiry express of the customer and after agreement between the parties, HomeDay can keep this sum for the rent of another apartment, or for another period. In that case, the commitment of the parties is sealed by the sending of a new E-mail by HomeDay.
The contract is sent to the customer one month before the beginning of the stay. The balance of the price of the rent is payable by the customer in the delivery of keys. 


4. CANCELLATION OF THE CONTRACT

In case of cancellation on the initiative of the customer 60 days and more before the beginning of the stay, the acount will be less restored 10 % to cover the expenses of bookings. If the cancellation intervenes between the thirtieth day and the fifty-ninth day preceding the beginning of the stay, 50 % of the deposit will be returned.
In case of cancellation less than 30 days before the beginning of the stay, there will be no possible refund.


In case of cancellation by HomeDay, the completeness of the deposit will be restored, including the possible expenses of bookings or payment.

Besides, if the cancellation intervenes 60 days and more before the beginning of the stay, Homeday will pay to the customer an allowance of 10 % of the amount of the paid deposit. If the cancellation intervenes between the thirtieth day and the fifty-ninth day preceding the beginning of the stay, HomeDay will pay to the customer an allowance of 50 % of the amount of the paid deposit. If the cancellation intervenes less than 30 days before the beginning of the stay, HomeDay will overturn in.

The allowance aimed at the previous paragraph will not be paid to the customer if the cancellation is due to a major case of strength or if a proposition of rehousing is made for the customer for considered period, and for services and price list equivalents.


5. PAYMENT

From his arrival and at the latest to the delivery of keys, the customer has to settle the balance of the amount of the booking.


The balance will be paid in euro. He can be settled in cash or by French check.

For lack of payment of the balance of the booking in the delivery of keys, a 20-€ sum will be charged in customer, due from the day after the arrival.

About is the duration of the stay, any lost, hoarse, damaged or damaged object must be replaced or paid off to At HomeDay in its replacement value by the customer who obliges himself there.

The return of keys to At Homeday at the end of stay does not take renunciation of At Homeday of allowances)for repair.

A lump sum will be demanded for the cleaning of premises. Its amount is defined by the contract.

6. SLEEPING AROUND

Premises being the object of the present reservation must not, under no pretext, be occupied by a number of persons superior to that indicated on the contract, except preliminary agreement of At HomeDay. If necessary,  At HomeDay can demand a supplement of rent, or refuse the entrance of places.


7. INSURANCE

The customer is insured an insurance company manifestly known against the risks, the fire and the water damages.

8. MAIN OBLIGATIONS OF THE CUSTOMER


- Use places peacefully.

- Make nothing, who of his fact either because of his family or of its relations can damage the tranquillity of the neighborhood or the other occupants, nor carry them discorder in any way, in particular by the noise.

- to occupy places personally, the booking is name specific and a photocopy of an ID card (passport or ID card) will be asked you, except preliminary agreement of At Homeday.


- Be able to under no pretext store meublants furniture, exception made for the linen and the menus objects.

- Make no modification and no change in the arrangement of furniture and places.

- Put in the balcony no garment or linen.


- Refrain to bring, whatever cause it is, no modification to the installations of electricity of gas and water existing in the booked places.

- Introduce no animal into premises reserved without prior authorization of HomeDay, possibility of detention being subordinated in particular to the fact that the animal causes no damage in the building, and no prevention of enjoyment in the neighborhood.


- Let execute during the stay, in the booked places, the works the obvious urgency of which does not allow the adjournment.

- Maintain the reserved places and return them in good condition of cleanliness and renting repairs at the end of enjoyment, in particular the sanitary and electric installations, the repair of which the customer would be made responsible if they came to deteriorate as a result of caresseuses or of neglect during the stay.


- Do not throw garbage, fragments, plugs, linen and waste water in the courses, in the toilets and the drivings of any orders.

- Inform at once the landlord of any disaster and the damages occurring in the reserved places, even if it results from it no visible damage. For lack of satisfying this obligation, he would be responsible for damages of any orders engendered by his silence or by his delay.

- Answer damages and losses which arrive by his own fact or by the fact of the persons of his house during the enjoyment of the accommodation, unless he proves which took place without his fault nor that of the persons knew indicated.

9. MAIN OBLIGATIONS OF AT HOMEDAY

- Deliver places rented in good condition for custom and for repairs, as well as equipments mentioned to the contract in good working order.

- Insure the customer the peaceful enjoyment of the reserved places and protect him from vices and natural defects to put it obstacle.


- Maintain premises in state to be of use to the planned usage.

- Except obvious urgency, do not make works in places booked during the duration of the stay. Any works will pull compensation of the customer, for the undergone preventions of enjoyment. 

- In case of force majeure making the chosen accommodation uninhabitable, to propose to the customer either an accommodation of the same size (or bigger) and offering the same services (or superior services) without possible discount, or an accommodation of lower size or offering lower services with discount. 

10. RESPONSABILITY

The customer gives up any appeal in responsibility or complaint against HomeDay in case:

1) of theft, attempt of theft, any criminal act or any assault the customer of which could be a victim in the booked premises; the customer gives up expressly to the advantage of the article 1719 paragraph 3 of the civil code, HomeDay assuming no obligation of surveillance; 

2) of irregularities, bad functioning or interruption of elevators, service of the water, the electricity, the gas, the telephone, the air conditioning, the generating sets of any computer systems and the collective services and common elements of equipment of the building or appropriate for the rented accommodation ;

3) of damages caused in premises, rented and / or in any movable elements being as a result of leaks, of infiltrations, of humidity or the other circumstances there;

4) of generative schemes of damages of the other occupants of the building;

5) of late arrival of the customer in places, the fact in particular of difficulties at the level of transport;

6) of nuisances, in particular sound, susceptible to arise from the outside of the accommodation ;

7) of accidents arising in the booked premises or because of premises booked during the duration of the lease, whatever is the cause;

8) of dysfunction of the Internet or the cable television, or in case of not compatibility of the equisetums of the accommodation with those of the customer.

11. CHOICE OF RESIDENCE

For the execution of the present, the parties make choice of residence for their respective addresses indicated to the contract or communicated during the booking.


12. INTERPRETATION

In case of doubt on the interpretation of the present general conditions, the French version will prevail over the English version. 


1/How to reserve?

First of all send a demand of booking by email.

If the period which you wish is available, an advance of 50 % of the amount of the booking will be asked you to reserve.

The advance can be sent by check (French), or by bank transfer (freshly of transfer at your expense).


2/ The  Contract

From your record booking (only in reception of the payment), a contract established to your name and indicating your dates of stay will be sent to you by e-mail. Print this contract, because you will find all the information there concerning your arrival for the stay.

3/ Payment


The rest of the booking must be settled either in cash (Euro) the day of your arrival, or by check (French).

4/Your stay

The apartment is at your disposal of the 1st day of your contract at 5:00 pm in the last day of your contract at 10 am, unless a different agreement. 

5/ Deposit for the stays of month and more

A deposit will be required.

The deposit must be settled or in cash (Euro ) the day of the arrival, or by check (French) .


The deposit will entirely be returned you when you will return the keys of the apartment.

6/ Cancellation

In case of cancellation more than 60 days before the beginning of your stay, your deposit will be less returned you 10 % to cover the expenses of bookings. If the cancellation intervenes more than 30 days before the beginning of your stay, 50 % of the deposit will be returned you. Beyond this deadline, there will be no possible refund.
